sales are made subject to the following terms and conditions; Steel Dynamics
Roanoke Bar Division's acceptance of any purchase orders for goods is
expressly made conditional on Purchaser's assent to these terms
and conditions. |

Prices
listed here are based on furnishing steel to ASTM Specifications
A575, A36, and A569 and are subject to addition of extras, where
applicable, as listed. For prices on other specifications, please
inquire. |
| 3. |
All
prices are F.O.B. our mill, Roanoke, Virginia, based on theoretical
weight and subject to the price in effect at time of shipment. |
| 4. |
Subject
to credit approval, payment terms are 1/2% 10 days, Net 30 days. |
| 5. |
Orders
may not be changed or canceled after the material is in process
except with our consent. |
| 6. |
All
material will be produced in accordance with specifications on
our written-order acknowledgment, subject
to standard manufacturing variations. Technical advice furnished by Steel
Dynamics Roanoke Bar Division represents our considered opinion only. It
is the responsibility of the Buyer
to determine whether such advice
should be followed. |
| 7. |
No
claim for damages for materials that do not conform to specifications
will be allowed unless Roanoke
is given immediate notice after delivery of materials to the first destination
to which they are shipped
and allowed an opportunity to inspect them. |
| 8. |
No
rust claims allowed for material purchased from mill inventory
or held at the mill after rolling. |
| 9. |
Material
that does not conform to specifications shall be replaced, or refund
of purchase price made. We shall
have no liability for damages in excess of the purchase price and shall not be
liable for any incidental or consequential damages. No material may be
returned,
modified, or disposed of
without our consent. No credits or debits will be honored without prior approval
by the Sales Department. |

Charges
for prepaid shipments will be added to the invoice. Title passes
to Purchaser when Roanoke
delivers material to carrier. |
| 11. |
All
claims for material damaged in transit are to be filed with Pittsburgh
Logistics by the customer. |
| 12. |
Length
tolerance is minus -0", plus 2". |
